These Terms & Conditions (“Terms”) apply to the website, services, and content (“Services”) provided by Sujan Chokhal — Sales & Marketing Analyst. By accessing or using these Services, you agree to comply with these Terms.

1) Definitions

• “Deliverables”: Reports, dashboards, presentations, campaign plans, or any final output materials.
• “Website”: This personal/portfolio website, including all its pages and content.

2) Website Usage

• Content on this website (text, graphics, case studies) is for informational purposes only.
• Reproduction, copying, or redistribution of any content requires prior written permission.

3) Services

Services offered by Sujan Chokhal may include market research, data analysis, sales strategy, marketing campaign planning/review, reporting, and dashboard creation. The scope of work will be clearly defined in the Proposal/SoW (Scope of Work).

4) Fees, Payment & Refunds

• Fees will be as per the Proposal/SoW; applicable taxes/charges may be added.
• Non-payment may lead to suspension or delay of services.
• Refund policies will be as specified in the Proposal/SoW; typically, no refunds once deliverables are provided.

5) Client Responsibilities

• Providing accurate data, access, and timely feedback.
• Ensuring all provided materials are legally usable.

6) Intellectual Property

• Pre-existing templates/frameworks/code/libraries remain the property of Sujan Chokhal.
• Usage rights of final deliverables will be granted as per the Proposal/SoW terms.

7) Confidentiality

Confidential information provided by the client will be kept secure as per NDA/Agreement terms. Sample/case studies may only be published after permission or anonymization.

8) Data & Privacy

• Personal or sensitive data will be processed as per applicable laws.
• Third-party tools (e.g., analytics, dashboard, ad platforms) are governed by their own Terms & Privacy Policies.

9) Communication

Official communication will be via email or mutually agreed channels. Meeting minutes and feedback cycles will be defined in the Proposal/SoW.

10) Portfolio Usage

Non-confidential deliverables/results may be used by Sujan Chokhal for portfolio/case studies unless otherwise agreed in writing.

11) Third-Party Tools

Use of third-party tools/services involves risks/limitations accepted by the client; such tools are governed by their respective providers' terms.

12) Limitation of Liability

Sujan Chokhal shall not be liable for any indirect, incidental, special, or consequential damages. Direct liability is limited to the amount paid for the services.

13) Non-Solicitation

During the engagement and for 6 months thereafter, neither party shall solicit or hire the other party’s employees/contractors without written consent.

14) Termination

• Either party may terminate with proper notice or for breach of Terms.
• Pending payments will be due, and deliverables transfer will follow the Proposal/SoW process.

15) Governing Law

These Terms shall be governed by the laws of Nepal. Disputes shall be under the jurisdiction of the courts in Kathmandu, Nepal.

16) Modifications

Terms may be updated periodically. New Terms take effect upon the “Last updated” date change.
